1. Agreement to these terms

These Terms & Conditions (“Terms”) form an agreement between you and BiteText (“we”, “us”) governing your use of the BiteText SMS service, website and management portal (together, the “Service”). By texting our number, creating an account or subscribing, you accept these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. You confirm that the mobile number you register is yours and that you are authorized to receive messages on it.

3. The Service

BiteText lets you send photos and short text descriptions of food by SMS or MMS. We return an estimate of calories, protein, carbohydrates and fat, and store the entry in your management portal.

Estimates are generated automatically from images and text and are approximate. They may be inaccurate for mixed dishes, hidden ingredients, oils, sauces or portion sizes we cannot see.

4. Not medical advice

The Service is provided for general informational and wellness purposes only. It is not medical, nutritional, diagnostic or treatment advice, and it is not a substitute for consulting a qualified professional. Never rely on BiteText for decisions related to a medical condition, pregnancy, an eating disorder, allergies or medication. If you have or suspect a health condition, speak with a licensed clinician.

5. Messaging terms and rates

By subscribing you consent to receive SMS/MMS messages from us related to your account and your entries. Message frequency depends on how often you send photos. Message and data rates may apply and are charged by your mobile carrier, not by us.

Text STOP at any time to opt out of messages, and HELP for assistance. Opting out ends the messaging portion of the Service; you remain responsible for cancelling your subscription in the portal. Carriers are not liable for delayed or undelivered messages.

6. Subscription, billing and renewal

Access to the Service costs $9.99 per month (plus applicable tax) and is billed in advance to your payment method. Your subscription renews automatically each month until you cancel.

You may cancel at any time from the management portal. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not provide partial-period refunds.

We may change pricing with at least 30 days’ notice by email or SMS. Continuing to use the Service after a price change takes effect means you accept the new price.

7. Your account

You are responsible for keeping your login credentials and phone secure and for all activity that happens through your account or number. Tell us promptly at support@bitetext.app if you believe your account has been compromised.

8. Acceptable use

You agree not to: send unlawful, harassing, hateful or sexually explicit content; send photos of people who have not consented to be photographed; upload malware; attempt to reverse engineer, scrape or overload the Service; resell or share access to your account; or use the Service to build a competing product.

9. Your content

You keep ownership of the photos and messages you send. You grant us a limited licence to store, process and display that content in order to operate the Service, provide your estimates and support you. We may use de-identified, aggregated data to improve accuracy. You can delete individual entries, or your whole account and its content, from the portal.

10. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend or discontinue features, and we may impose reasonable usage limits to protect the Service.

11. Suspension and termination

We may suspend or terminate your access if you breach these Terms, if payment fails, or if we are required to do so by law. You may stop using the Service at any time by cancelling your subscription and texting STOP.

12. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that nutrition estimates will be accurate, complete or suitable for your goals.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold us harmless from claims, damages and expenses arising out of your use of the Service, your content, or your breach of these Terms.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material we will notify you by email or SMS before they take effect. The “last updated” date above shows the current version, and continued use after the effective date means you accept the update.

16. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. You and we agree to try in good faith to resolve any dispute informally by contacting support@bitetext.app first. Otherwise, disputes will be resolved in the state or federal courts located in New York.
